North Dakota speeding ticket: fine, points and your options

North Dakota charges $3 per mph over, $20 minimum, or $5 per mph where the limit is above 65, plus $20 at 16 over. School zones start at $40 and work zones at $150. What does a speeding ticket cost in North Dakota?

$3 for each mile per hour over the limit, or $20, whichever is more. Where the limit is posted above 65, it's $5 per mile per hour with the same $20 floor. At 16 over or more, another $20 is added. That's NDCC 39-06.1-06, subsections 4 and 6.

School zones and work zones have their own floor. In a school zone it's $40 for 1 to 10 over, then $1 for each mph past 10. In a work zone it's $150 for 1 to 10 over, then $2 for each mph past 10, but only when workers are present and the sign says "Minimum Fee $150." How many points is a speeding ticket?

Zero to 15, depending on how fast and on the posted limit. The two schedules are in NDCC 39-06.1-10, subsection 3(a), paragraphs 30 and 33.

School and work zone tickets use the same points. The bigger fee doesn't add any. NDDOT suspends at 12, so 36 over on a road posted 65 or less is a suspension on its own. Speeding ticket points goes through each band, and North Dakota speed limits tells you which table your road falls under.

What should I do in the first 14 days?

Pick one of these before the 14 days from the citation date run out:

  1. Pay the fee or post bond. That admits the violation, the court reports it, and NDDOT enters the points.
  2. Ask for a hearing. You sign the request on the citation and post a bond equal to the fee. How the hearing works.
  3. Elect a driver training course in lieu of points. You still post the bond, and you tell the clerk in writing at the same time.

Option 3 is where people trip. The state courts' payment page says: "STOP! DO NOT MAKE A PAYMENT if you are requesting a hearing for a traffic case" or have questions about taking a defensive driving course (ndcourts.gov). The court's own self-help guide says you notify the clerk by mailing written notice in the same envelope as the citation, or handing it over when you pay in person (ND Legal Self Help Center). Which speeding tickets can I keep off my record?

Any worth 5 points or fewer. That's up to 25 over where the limit is 65 or less, and up to 20 over where it's above 65. NDCC 39-06.1-10.1 sets the rest:

  • once in 12 months, counted back from the date on the new ticket
  • NDDOT needs your certificate within 30 days of telling the clerk
  • the bond is forfeited anyway, so the fee doesn't go down
  • electing "forfeits any point reduction option under section 39-06.1-13," which is the 3-point reduction

Who shouldn't buy a course for this ticket?

Anyone whose ticket is 0 points. That's up to 10 over where the limit is 65 or less and up to 5 over where it's higher. There's nothing to keep off.

A 1-point ticket is close to the same answer. NDDOT removes a point for every three months without new points (NDCC 39-06.1-13(1)), so it's gone in a season. Spending your once-a-year election and the 3-point option on it is a bad trade.

The exceptions are drivers near a limit. If you're at 11 points, one more suspends you. If you're under 18, the license is canceled at 6 points (NDCC 39-06-01.1), so a 1-point ticket at 5 points matters.

What about racing or showing off?

Those aren't speeding tickets. Exhibition driving is 3 points. Racing is 10, which can't be elected away. Exhibition driving and racing tickets.

Usually not. One point comes off by itself after three months with no new points. The election also uses up your once-a-year chance and gives up the 3-point reduction option.
