What is exhibition driving?
NDCC 39-08-03.1 defines it as driving "in a manner which disturbs the peace by creating or causing unnecessary engine noise, tire squeal, skid, or slide upon acceleration or braking," or making "unnecessarily abrupt turns."
What counts as racing?
- Drag race: two or more vehicles starting side by side and accelerating to outdistance each other, or vehicles timed over the same course.
- Race: trying to outgain or outdistance another vehicle, or keeping another vehicle from passing.
Where does it apply?
On a "highway, street, alley, sidewalk, or any public or private parking lot or area." A store parking lot counts.
Organized events on a track or private area set aside for racing are not covered.
What are the penalties?
| Violation | Fee | Points |
|---|---|---|
| Exhibition driving | $50 | 3 |
| Drag racing or racing | $100 | 10 |
How close is 10 points to a suspension?
Two points. A stop sign ticket or a speeding ticket for 16 over would do it. For a driver under 18, 10 points is past the 6 that cancels a license.
Can a course keep the points off?
For exhibition driving, yes. It's 3 points, so you can elect a driver training course at court when you post bond.
For racing, no. It's 10 points, and the election stops at 5.
What can a course do after a racing ticket?
Take 3 points off, from 10 to 7. Do it soon. At 10, one small ticket suspends you. At 7, you have room.
