Out-of-state tickets and North Dakota points
By Road Ready Safety · Checked against North Dakota law on
Short answer
If you hold a North Dakota license and get an ordinary ticket in another state, North Dakota doesn't add points for it. Points are added only for serious criminal offenses such as DUI or reckless driving. If you're from another state and get a ticket in North Dakota, NDDOT can report it to your home state, which decides what happens.
- ND driver, ordinary ticket elsewhere
- No North Dakota points
- ND driver, serious offense elsewhere
- Points can be added
- Visitor ticketed in North Dakota
- Reported to home state

- NDCC 39-06-26 and 39-06-27
I have a North Dakota license and got a ticket in another state. Do I get points?
Usually not. NDCC 39-06-27 says the section "may not be construed as authorizing the assessment of points against a resident's driving record" except on conviction of a criminal offense "equivalent to one of those offenses defined in section 39-06.1-05."
Those offenses include driving under the influence, reckless driving, leaving the scene of an accident, and driving while suspended.
Can North Dakota still act on an out-of-state conviction?
Yes. The director may suspend or revoke a resident's license on notice of a conviction in another state or a tribal court for an offense that would be grounds for suspension or revocation here.
Do I still have to deal with the ticket?
Yes, with the court in the state that issued it. Ignoring it can cost you your driving privilege in that state.
I'm from another state and got a ticket in North Dakota. What happens?
You respond to the North Dakota court on your citation within the time it gives. NDDOT "may notify the licensing authority in the state in which the nonresident resides or is licensed."
What your home state does with it depends on that state's rules. The Fargo Municipal Court gives the same advice on points: contact the state you're licensed by.
Can a visitor use the North Dakota course?
The course affects a North Dakota driving record. If your license is from another state, ask your home state's licensing agency what it accepts before you pay for any course. We'd rather not sell you one that doesn't help.
How do I see what North Dakota has on my record?
Order a North Dakota driving record for $3. It shows your point total.
What about tickets on a reservation?
The director can act on reports from tribal courts. The same limit on points applies: they're added only for the serious criminal offenses.
Quick answers
Do out-of-state tickets put points on a North Dakota license?
Not for ordinary violations. NDCC 39-06-27 allows points only for a conviction of a criminal offense equivalent to those listed in section 39-06.1-05, such as DUI or reckless driving.
Does North Dakota report tickets to other states?
It can. Under NDCC 39-06-26 the director may notify the licensing authority in the nonresident driver's home state.
I live in another state and got a North Dakota ticket. Will I get points?
That is decided by your home state. Contact the licensing agency of the state where you are licensed.
