Point reduction or in lieu of points: which one in North Dakota?

Short answer
If you just got a ticket worth 5 points or fewer and haven't posted bond, elect the course in lieu of points. If the points are already on your record, use the 3-point reduction. One course can't do both: the law says a driver who makes the in-lieu election forfeits the reduction option.

What is the difference?
The reduction subtracts. The in-lieu election prevents. With the reduction, NDDOT takes 3 points off a total you already have. With the election, the points for one new ticket are never added.
When is the in-lieu election better?
When the ticket is worth more than 3 points. A ticket for 21 to 25 mph over the limit is 5 points in a zone posted at 65 or less. Elect the course and none of the 5 are added. Let the points post and take the course later, and you get 3 back.
It's also better when you're close to 12. At 9 points, a 3-point ticket takes you to 12 and a suspension. The election keeps you at 9.
When is the reduction better?
- The points are already on your record.
- The ticket is worth 6 points or more, which rules out the election.
- You used the election in the last 12 months.
- You missed the chance to elect at court.
- You don't want a 30-day deadline.
Can I use both in the same year?
Not from the same course. NDCC 39-06.1-10.1 says a person making the election "forfeits any point reduction option under section 39-06.1-13." Each option is also limited to once in 12 months.

What does each one cost?
The same. You pay the ticket either way, because the bond is forfeited even when you elect the course. You pay for the course either way. Ours is $24.99.

Three examples
You have 2 points and get a ticket for 12 over in a 55 zone. That's 1 point. Neither option matters much. Points drop by 1 every three months on their own.
You have 6 points and get a ticket for 22 over in a 55 zone. That's 5 points. Elect the course at court and you stay at 6.
You have 10 points and no new ticket. Take the course now and send in the certificate. You go to 7.
