|---|---|---|
| Speeding by 5 mph or less | RSMo 304.009 says no points shall be assessed | $50.50 on the state schedule |

What counts as a moving violation?
Missouri defines it as a traffic violation "where at the time of violation the motor vehicle involved is in motion." The definition leaves out driving without a valid registration and violations of the size and weight laws.
Any moving violation that isn't listed by name on Form 899 is 2 points.
Do I still have to deal with a no-point ticket?
Yes. The Missouri courts say you must respond by the court date on the citation, by pleading guilty and paying or by appearing. Failing to respond can lead to a suspension and a warrant.
Should I ask for the Driver Improvement Program on a no-point ticket?
No. The program keeps points off, and there aren't any. You can use it once in 36 months, so save it.
Can a ticket be changed to one with no points?
That's between you, the prosecutor and the court. We don't give legal advice. An attorney can tell you what's possible in your court.
