How many points suspend a license in Missouri?

Eight points in 18 months (RSMo 302.304). The Department of Revenue also sends a warning letter when you reach 4 points in 12 months.

How long is a points suspension?

  • First suspension: 30 days
  • Second suspension: 60 days
  • Third and later suspensions: 90 days

Those lengths apply if you file proof of insurance. The statute says that unless proof of financial responsibility is filed, "a suspension shall continue in effect for two years from its effective date."

What is the difference between a suspension and a revocation?

A revocation is longer, and you have to test again. Missouri revokes for one year at 12 points in 12 months, 18 points in 24 months, or 24 points in 36 months. After a revocation you retake the complete driver exam.

How do I get my license back after a points suspension?

For points from non-alcohol violations such as speeding, the Department of Revenue requires two things:

  1. Pay the $20 reinstatement fee.
  2. File proof of liability insurance on an SR-22 form, and keep it on file for two years from the start date of the suspension.

You can pay online at mydmv.mo.gov, by mail, or in person at the Jefferson City central office. You can't pay at a local license office. Card payments carry a convenience fee of 2.0% plus $0.25.

What happens to my points afterward?

They're reduced to 4 when you're reinstated. From there they drop each year you go without a new conviction. Time under suspension doesn't count toward that reduction.

Can I drive to work during the suspension?

Only with a Limited Driving Privilege. The Department of Revenue says you cannot drive while suspended "unless you apply for and receive a Limited Driving Privilege (LDP)." Driving while suspended is a 12-point conviction, which is a revocation.

Can I appeal?

Yes. You can appeal in the circuit court of the county where you live within 30 days after the notice is issued.

Can the Driver Improvement Program undo a suspension?

No. It keeps the points from a new ticket from being added. It can't remove points already counted, and it isn't a reinstatement requirement.

It helps before the suspension. If you have 5 or 6 points and a new ticket, ask the court for the program before you plead. With the points kept off, you stay under 8.
